Jodi Arias: Hell Hath No Fury – Charges


Arias was found guilty of first degree murder for the death of Travis Alexander. She faces the death penalty if convicted, which would make her one of only three women on Arizona’s death row.

Definitions by the Arizona State Legislature –http://www.azleg.gov/

13-1105. First degree murder; classification

A. A person commits first degree murder if:

1. Intending or knowing that the person’s conduct will cause death, the person causes the death of another person, including an unborn child, with premeditation or, as a result of causing the death of another person with premeditation, causes the death of an unborn child.

2. Acting either alone or with one or more other persons the person commits or attempts to commit sexual conduct with a minor under section 13-1405, sexual assault under section 13-1406, molestation of a child under section 13-1410, terrorism under section 13-2308.01, marijuana offenses under section 13-3405, subsection A, paragraph 4, dangerous drug offenses under section 13-3407, subsection A, paragraphs 4 and 7, narcotics offenses under section 13-3408, subsection A, paragraph 7 that equal or exceed the statutory threshold amount for each offense or combination of offenses, involving or using minors in drug offenses under section 13-3409, drive by shooting under section 13-1209, kidnapping under section 13-1304, burglary under section 13-1506, 13-1507 or 13-1508, arson under section 13-1703 or 13-1704, robbery under section 13-1902, 13-1903 or 13-1904, escape under section 13-2503 or 13-2504, child abuse under section 13-3623, subsection A, paragraph 1 or unlawful flight from a pursuing law enforcement vehicle under section 28-622.01 and, in the course of and in furtherance of the offense or immediate flight from the offense, the person or another person causes the death of any person.

3. Intending or knowing that the person’s conduct will cause death to a law enforcement officer, the person causes the death of a law enforcement officer who is in the line of duty.

B. Homicide, as prescribed in subsection A, paragraph 2 of this section, requires no specific mental state other than what is required for the commission of any of the enumerated felonies.

C. An offense under subsection A, paragraph 1 of this section applies to an unborn child in the womb at any stage of its development. A person shall not be prosecuted under subsection A, paragraph 1 of this section if any of the following applies:

1. The person was performing an abortion for which the consent of the pregnant woman, or a person authorized by law to act on the pregnant woman’s behalf, has been obtained or for which the consent was implied or authorized by law.

2. The person was performing medical treatment on the pregnant woman or the pregnant woman’s unborn child.
3. The person was the unborn child’s mother.

D. First degree murder is a class 1 felony and is punishable by death or life imprisonment as provided by sections 13-751 and 13-752.

13-1104. Second degree murder; classification

A. A person commits second degree murder if without premeditation:

1. The person intentionally causes the death of another person, including an unborn child or, as a result of intentionally causing the death of another person, causes the death of an unborn child; or

2. Knowing that the person’s conduct will cause death or serious physical injury, the person causes the death of another person, including an unborn child or, as a result of knowingly causing the death of another person, causes the death of an unborn child; or

3. Under circumstances manifesting extreme indifference to human life, the person recklessly engages in conduct that creates a grave risk of death and thereby causes the death of another person, including an unborn child or, as a result of recklessly causing the death of another person, causes the death of an unborn child.

B. An offense under this section applies to an unborn child in the womb at any stage of its development. A person may not be prosecuted under this section if any of the following applies:
1. The person was performing an abortion for which the consent of the pregnant woman, or a person authorized by law to act on the pregnant woman’s behalf, has been obtained or for which the consent was implied or authorized by law.

2. The person was performing medical treatment on the pregnant woman or the pregnant woman’s unborn child.
3. The person was the unborn child’s mother.

C. Second degree murder is a class 1 felony and is punishable as provided by section 13-705 if the victim is under fifteen years of age or is an unborn child, section 13-706, subsection A or section 13-710.

13-1103. Manslaughter; classification

A. A person commits manslaughter by:

1. Recklessly causing the death of another person; or
2. Committing second degree murder as defined in section 13-1104, subsection A upon a sudden quarrel or heat of passion resulting from adequate provocation by the victim; or

3. Intentionally aiding another to commit suicide; or
4. Committing second degree murder as defined in section 13-1104, subsection A, paragraph 3, while being coerced to do so by the use or threatened immediate use of unlawful deadly physical force upon such person or a third person which a reasonable person in his situation would have been unable to resist; or

5. Knowingly or recklessly causing the death of an unborn child by any physical injury to the mother.

B. An offense under subsection A, paragraph 5 of this section applies to an unborn child in the womb at any stage of its development. A person shall not be prosecuted under subsection A, paragraph 5 of this section if any of the following applies:

1. The person was performing an abortion for which the consent of the pregnant woman, or a person authorized by law to act on the pregnant woman’s behalf, has been obtained or for which the consent was implied or authorized by law.

2. The person was performing medical treatment on the pregnant woman or the pregnant woman’s unborn child.
3. The person was the unborn child’s mother.

C. Manslaughter is a class 2 felony.

DAY 2 of delib….NOT a good sign. Really, with good, solid common sense and thought, this decision should have been done in a couple hours. NO ONE who is innocent would like like she did. NOONE who is defending themselves goes to that extent, shooting, stabbing repeatedly, decapitation……..think about it. How hard is it??

First I would like to send my sincere condolences to Travis Alexander’s family and believe it or not Jody Arias’ family are victims too.
I would like to send a shout out to the jury to convict that sociopath of muder in the 1st degree.
Not once during this trial has she uttered she was sorry or has shown remorse.
I also believe Jody Arias had help in committing this crime. Someone helped her move that body. She could not move 189 pounds of dead weight by herself. Has anyone explored how she did it. I don’t think adrenaline alone was a factor.

HLNAfterDark proved that she was more than capable of dragging his body down the hall. They had a woman the same height and weight as Jodi, drag a dummy that weighed the same as Travis the same distance as the hallway and had her put the body in the shower and pose it like Travis’s body was when found. She had no problems. And don’t forget that Jodi took the sheet off of his bed to help maneuver the body. One of the pics deleted in the camera was of her pulling his body down the hallway on a bloody sheet.

I don’t know how Travis’ family can sit in the court room day after day looking at that face of evil. There she sits, taking notes; whispering back and forth with her lawyer. I absolutely HATE to look at her. The complete lack of remorse. She sits there like someone being charged with theft, or some petty crime, rather than the most heinous crimes imaginable. I think she deserves to spend the rest of her miserable life in a tiny cell without contact with anything or anyone from the outside world. No books, no TV, no communication.

Remember the specialist about the gun shot. Jodi says she shot him first, then he clawed at her clothes and said , i’m going to kill you bitch. The specialist said that a gunshot to the head would have dropped him instantly and died within moments. That wound and the sliced throat would have been the quickest. Then the stab to the chest would have been the 3rd most leathal. So she lied about the whole thing.

This is a horrible crime committed by a woman who obviously is lacking a full deck. I believe she went there to reconcile with Alexander and if that didn’t work out, kill him.
However, I don’t think she should get the death penalty because this is a crime of passion. She didn’t kill him for profit, it was an extreme case of jealousy. Passion and jealouly can cause a person to go insane and it this instance, I think she was already half nuts.
This is an extreme example of where you can pay a doctor enough money and they will say anything.

I don’t agree. She deserves to die for her crime. She killed Travis so no one else could have him. And, she has shown no remorse what so ever, other than the fact that she wasn’t allowed to put make-up on before she was booked into jail. She should pay. Why should she be allowed 3 meals a day, cable TV, a library, etc? Travis doesn’t have that option.

Tami, I agree with you. I think the Casey Anthony case gave crazy people a few ideas on how to kill your baby and get away with it. How come the law favors the criminal? How come, if you get acquitted, prosecution can’t “appeal”, but if you are convicted, you get 2, 3 and more chances? What the heck? I don’t trust the system. It sucks. :(

It is not the law that will fail, it is the weakest link in the system, the human jurors. Maybe we need a point scoring system, an automated system that allows the two sides to input data, then it computes the results based on sheer logic. None of what Jodi did or says makes any sense. The killing took place in the bathroom & Travis’s body was found in the shower, what I don’t know/missed is how so much blood ended up on the bedroom carpet? I hope someone will fill me in.

Since our only souce of information is Jodi and she is the world’s biggest liar and of course she has “FOG” issues and cannot remember a thing. We really don’t know how the blood got on the carpet and Prosecutor Martinez hasn’t even tried to speculate how that blood spot got there. I personally think that Travis tried to run out of the room after she stabbed him in the chest and back. I think that Jodi ran after him and slashed his throat in the hallway. That’s why all the blood. I don’t have any proof but since the gunshot wound didn’t bleed much per the expert testimony, the blood had to have come from his stab wounds or throat slashing…. No one should ever have to die like that! I feel so bad for Travis. Can you imagine his terror as he was being murdered! I think that evil look is permanently fixed in Jodi’s eyes. Evil comes from the soul and since she has had direct contact with evil it is showing up in her eyes and conduct. She cannot hide it she is the epitome of pure evil!

What could possibly motivate someone to kill someone in the way Travis was killed? It would have been just so much easier for Jodi to have just turned around, walk away, and move on with her life. Travis might have said some verbal things that did not set well with Jodi, but to call it mental abuse to the extent that she would carry out such a heinous act?
